These Terms & Conditions constitute a legally binding agreement made between you and XARA Arts concerning your access to and use of the XARA website, the XARA smart contracts, and any related services or games.

By accessing or using the Site, you agree that you have read, understood, and agreed to be bound by all of these Terms & Conditions. If you do not agree with all of these terms, you are expressly prohibited from using the Site and must discontinue use immediately.

When you mint or purchase a XARA digital asset (NFT) via OpenSea, you own the cryptographic token representing the digital asset on the blockchain. You have the right to trade, sell, or give away your NFT.

However, owning a XARA NFT does not grant you ownership of the Xara Arts brand, lore, trademarks, or the underlying intellectual property (the actual artwork) unless explicitly stated otherwise in a separate commercial license agreement.

Unless otherwise indicated, the Site, the smart contracts, and all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics on the Site are owned or controlled by XARA Arts and are protected by copyright and trademark laws.

You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.

Prohibited activity includes attempting to bypass any security measures of the Site, using automated scripts to extract data, or engaging in any activity that interferes with or disrupts the Site or the servers and networks connected to the Site.

XARA digital assets are created as art and collectibles, not as investment vehicles. NFT value is highly volatile and can go up, down, or to zero.

Nothing on this site constitutes financial advice. We make no promises or guarantees regarding the future value, utility, or financial returns of any assets associated with the XARA ecosystem.

You accept and acknowledge all risks associated with using cryptocurrency and interacting with blockchain technology, including but not limited to, the risk of hardware, software and internet connections, the risk of malicious software introduction, and the risk that third parties may obtain unauthorized access to information stored within your wallet.

In no event will XARA Arts, our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profit, lost revenue, loss of data, or other damages arising from your use of the Site.

We reserve the right, in our sole discretion, to make changes or modifications to these Terms & Conditions at any time and for any reason. We will alert you about any changes by updating the "Last Updated" date of these Terms & Conditions, and you waive any right to receive specific notice of each such change.
